Subject: NDE: Repeal of 126 and the impact on E-RATE and Tech Plans
Information from Brian Halstead:
At this point, nothing has changed. Everything in Nebraska is a K-12
school district; the repeal of LB 126 did not recreate Class I school
districts. Schools should proceed today as they did last week.

Future litigation and legislation will occur and the result cannot be
foreseen. See todays Omaha World Herald as Attorney General John Bruning
has been quoted with a statement that may give more insight into the
issue. (sorry I don't have it front of me to get the exact wording).
At this point in time those who have already filled tech plans have
included any former Class I's in their tech plan. Those who have not
will need to do so for both Tech Planning and E-Rate.
As many of you know we can re-open previously certified tech plans to
edit and recertify if changes are needed. A new certification number and
letter will be issued. Send an email to me if you need this done. You
will have to make sure you use the most recent certification number for
filing purposes.
